Website Terms of Use
1. Acceptance and website operator
Welcome to potyl.com (the “Site”), operated by Peter Mark Potylicki, an individual sole proprietor doing business under the name POTYL & CO. (“POTYL,” “we,” or “us”), based in South Carolina, United States.
By using the Site, you agree to these Website Terms of Use (“Terms”). If you do not agree, please do not use the Site. These Terms concern website use only; paid consulting services require a separate written agreement.
Contact: [email protected] or 803-470-3938.
2. General information; no consulting relationship
Content on the Site describes our perspective, services, and general business topics. It is provided for informational purposes and is not individualized business, legal, tax, financial, investment, or other professional advice. Reading the Site or submitting an inquiry does not establish a consultant-client relationship, create a duty to advise you, or obligate either party to enter an engagement.
Business decisions involve uncertainty and depend on facts specific to each situation. We do not guarantee revenue increases, profitability, rankings, growth, or any particular business result.
3. Contact submissions
You agree to provide accurate contact details and not to submit unlawful, abusive, misleading, or malicious material. Do not send confidential business information, passwords, trade secrets, or sensitive personal data through the public contact form unless we have arranged an appropriate secure process and, where needed, confidentiality terms.
We may review and respond to legitimate inquiries but do not guarantee a response or acceptance of work. Submission does not reserve availability or establish a contractual relationship.
Information you submit is handled as described in our Privacy Policy.
4. Intellectual property
Unless stated otherwise, the Site’s original text, branding, visuals, diagrams, and design elements are owned by POTYL or used with permission and are protected by applicable intellectual-property laws. You may view and print limited portions for your personal or internal business evaluation. You may not reproduce, republish, sell, distribute, scrape at scale, or create derivative commercial works from Site materials without prior written permission, except as permitted by law.
All third-party names, trademarks, and materials remain the property of their respective owners. References to third parties do not imply affiliation or endorsement.
5. Acceptable use
You may not interfere with the Site’s operation or security, attempt unauthorized access, transmit malware, misuse forms, impersonate others, or use automated methods that place unreasonable burdens on the Site. We may restrict access where reasonably necessary to protect the Site, users, or our legitimate interests.
6. Third-party services and links
The Site may link to independent sites and use third-party services for hosting, spam prevention, and communications. We do not control third-party content or practices and are not responsible for those services except to the extent required by applicable law. Review any third-party terms and policies that apply.
7. Disclaimers
TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS GENERAL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.
Nothing in these Terms excludes a warranty, right, or remedy that cannot lawfully be excluded.
8. Limitation of liability
TO THE EXTENT PERMITTED BY APPLICABLE LAW, POTYL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING SOLELY FROM YOUR USE OF THE SITE, INCLUDING LOST PROFITS OR LOST DATA, EVEN IF ADVISED OF THEIR POSSIBILITY.
Nothing here limits liability that applicable law prohibits limiting, including liability for fraud or willful misconduct where such limitation is not permitted.
9. Indemnity
To the extent permitted by law, you agree to be responsible for third-party claims arising from your intentional misuse of the Site, infringement of others’ rights through content you submit, or material violation of these Terms.
10. Governing law and disputes
These Terms are intended to be governed by the laws of the State of South Carolina, without regard to conflict-of-laws principles, except where mandatory consumer-protection or other applicable law provides otherwise.
11. Changes and availability
We may modify Site features or these Terms from time to time. Updated Terms will be posted with a revised effective date. Changes will not apply retroactively where prohibited by law. Continued use after an effective update constitutes acceptance only to the extent permitted by law.
12. Miscellaneous
If a provision is found unenforceable, the remaining provisions remain in effect to the extent legally possible. A failure to enforce a provision is not a waiver. These Terms do not create an agency, partnership, employment, or joint-venture relationship with Site visitors.
